Federal judge clears Ørsted to restart construction on the Sunrise Wind offshore project

Ever since Donald Trump’s reinstatement and return to office, there is one particular type of energy source that has been subject to political scrutiny, and that is wind energy. This means a lot of plans that were developed before Trump’s return to power have now been halted and are facing re-evaluation. One company recently got the go-ahead, so the forecast is not bleak for all projects.

Court decisions have been mixed so far, but in the latest case, a federal judge cleared Ørsted to restart construction on the Sunrise Wind offshore project.

The U.S. court system has been faced with the gruelling task of determining whether the Trump Administration was correct in its decision to close down wind projects or not. Some of the court cases take a long time to resolve. However, on February 2, 2026, the U.S. District Court for the District of Columbia finally granted the preliminary injunction that Sunrise Wind LLC was seeking.

This was a massive relief for Ørsted because it permitted the company to restart construction. Some people were surprised to learn just how far the case had escalated, and they questioned what led up to the federal judge’s eventual decision.

Initially, there was a legal challenge against a suspension order issued by the U.S. Department of the Interior’s Bureau of Ocean Energy Management (BOEM) on December 22, 2025. This suspension order effectively halted construction on all five major offshore wind projects that were in the process of being built along the East Coast. The reasons why they were stopped included national security concerns.

However, most people are already aware of the previous comments made by President Trump that wind farms are expensive and ugly, so this likely played a part in the decision to stop all activities. Ørsted responded that the suspension order was unlawful and was destined to inflict irreparable harm on the Sunrise Wind project. After taking time to evaluate the case, the judge agreed and issued an injunction.

How is the Sunrise Wind offshore initiative expected to change moving forward?

When a specific development is labelled expensive and detrimental to national security, it’s unimaginable that a judge might unsuspend it. According to reports, it is now incumbent on Ørsted to adapt and develop a project that meets the criteria of what the government views as safe. The feeling among the corporation as it restarts activities is that safety is the main priority to ensure that the development is not halted, and most importantly, that the US population can receive a reliable energy source. 

Assessing the significance of the judge’s ruling in the context of U.S. offshore wind

Wind developers are starting to find joy from the court decisions that are ruling in their favour, but some are still going through the legal process. The Sunrise Wind decision is the fifth similar injunction that permits an offshore wind project to resume construction after being halted. This signals a major victory all around because now communities can enjoy the benefits that they were promised to begin with.

What are the advantages that the Sunrise Wind Offshore project will bring to the community?

People can begin to look towards a future of perks and benefits from the wind initiative. Sunrise Wind is universally acclaimed as a cornerstone of New York’s plans to expand renewable energy and reduce overreliance on fossil fuels. Once the development is fully commissioned, it is expected to provide electricity for about 600,000 homes, matching up with 2026’s most significant projects.

The execution of energy developments comes with multiple hurdles that the developers do not always make public. However, now and then, the complex issues that arise become public information. The judge ruling for Ørsted is particularly significant because it is officially ending a suspension that could have prevented one of the most significant renewable energy developments off the U.S. East Coast.
