Near San Antonio, a worker died operating a mini-excavator in a school crawl space; regulators proposed nearly $300,000 in penalties against D L Bandy Constructors Inc. and a staffing agency for failing to identify the space as permit-required and for sending a worker in without training or a documented rescue plan.
The pattern holds outside confined spaces. Regulators proposed over $3.5 million in penalties after a sulfuric acid spill in Channelview, Texas, citing failures to protect workers during cleanup. In Alvin, a trench collapse drew a proposed $343,797 against Blazey Construction Services LLC for inadequate protective systems and reporting failures. None of these citations came down to a single missing form. Each described a written program that was thin or absent, which is why regulators keep asking for training proof and evidence of what the employer knew.
